Flyesim – Terms and Conditions
1. Introduction
These Terms of Use ("Terms") govern your access to and use of Flyesim's mobile application, website, and related services ("Services"). By purchasing or using any of our Services, you agree to be bound by these Terms, along with our Privacy Policy and any other applicable terms provided to you.
2. Eligibility and Device Requirements
To access and use Flyesim Services, you must:
- Have an unlocked, eSIM-compatible device.
- Be the sole authorized user of the device and the Flyesim account used for the purchase.
You are solely responsible for ensuring that your device supports eSIM technology before making a purchase. Compatibility information can be found in our Help Center.
3. Flyesim Account
Your Flyesim account is personal to you and cannot be transferred or shared. Flyesim reserves the right to suspend or terminate your account at any time if we suspect any misuse, security breach, or violation of these Terms.
If your account is suspended or terminated due to breach of our policies or misuse of the Services, no refund or compensation will be provided.
4. Prices and Payments
- All prices for our Services are displayed in U.S. Dollars (USD), unless otherwise stated.
- Prices exclude applicable taxes, fees, or charges that may be added based on your billing location.
- Payments must be completed through the available secure payment gateways on our app or website.
- Currency conversions and bank fees (if any) are your sole responsibility.
5. Activation and Validity
Your Flyesim bundle will activate automatically once you arrive at your destination and your device connects to the local network.
Each bundle includes a validity period (e.g., 7, 15, 30 days). Once activated, your bundle's validity period begins and cannot be paused or extended.
6. Replacement and Refund Policy
6.1 No Refunds
Once a bundle has been purchased, no refund will be issued under any circumstances, including but not limited to:
- User device incompatibility or locked devices.
- Incorrect destination or bundle selection.
- Expired or unused bundles.
- Connectivity issues resulting from user settings or local network restrictions.
- Change of travel plans.
6.2 Replacement and Refund Policy
In specific cases where a purchased bundle cannot be activated or used due to a verified technical issue originating from Flyesim or its network partners, Flyesim may, at its sole discretion, offer either a replacement eSIM for another destination or operator of equivalent value, or issue a full refund for the affected bundle.
To be eligible:
- The issue must be confirmed by Flyesim's technical team as caused by Flyesim or its partners.
- A refund or replacement request must be submitted within 30 days of purchase.
- You must cooperate fully with our support team to verify and troubleshoot the issue.
Flyesim's decision regarding the eligibility and form of compensation (refund or replacement) shall be final and binding.
6.3 Third-Party Purchases
If you purchased Flyesim Services through a third-party platform, reseller, or distributor, you must contact them directly for any support or claims. Flyesim is not responsible for purchases made outside our official channels.
7. Termination and Service Suspension
Flyesim partners with global telecom operators to ensure reliable coverage. However, if a service provider fails to meet our operational standards or experiences network issues, Flyesim may suspend or terminate affected bundles without prior notice.
In such cases, you may be eligible for a replacement bundle as outlined in Section 6.2.
8. Unauthorized Use and Fraud
Any unauthorized use of Flyesim Services, including resale, transfer, or fraudulent activity, may result in immediate account suspension. Flyesim reserves the right to deny any refund or replacement and may report fraudulent behavior to relevant authorities.
9. Limitation of Liability
Flyesim will not be liable for:
- Service interruptions caused by third-party operators or roaming partners.
- Delays or failures due to network coverage limitations or user device configurations.
- Losses, damages, or expenses arising from misuse or inability to use the Services.
Our total liability will not exceed the amount paid for the affected Service.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Togo, without regard to its conflict of law provisions.
